The reason for this code is to ensure that the members of the legal profession provide services that are in the best interest of their clientele and to ensure that these professionals are holding on to the laws that they are sworn to serve. The duties that are required of solicitors both at home and foreign are important to the legal structure of the UK. In the process of living by these laws you must show that you have a clear understanding of them in your legal and professional behavior showing that you are a person of character and dignity at all times. You will need to show that this code not only means a lot to you but that it is totally understood and carried out to the best of your abilities. You will need to remember that your duties should be applied to every situation and that you and your employees maintain them for as long as you are in legal practice. Ensuring that these duties are carried out, which means that you stick to them, comes before any legal obligation you have to any one case. This means that you can’t knowingly break the law because you are the solicitor for a client. You may have some obligation to your clients, but you also have obligations to the court and the rules of it come before any other rules. They offer these solicitors training, give them advice, and help them to deal with the regulators of the legal profession. It is their mission to help the solicitors who practice in the England and Wales area of the United Kingdom. The Law Society also has the “Solicitors Regulation Authority” that deals primarily with the regulation and the discipline of solicitors. It also is responsible to create and to enforce the standard that is used by solicitors in the area. Another important aspect of the Law Society is the “Legal Complaints Service”, which allows the public to make a complaint about any solicitor, while also ensuring that the matter is handled swiftly and any issues are reserved. The law Society has its own constitution called the “Royal Charter of 1845” and a number of other documents since then which include their “General Regulations”, “Law Society Bye Laws”, “Codes and Protocols”, “Code of Conduct”, and their “Register of Interest”. The Society also consists of 4 boards such as the “Management Board” and the “Legal Affairs and Policy Board”. These boards are typically in place to deal with all issues a solicitor may have including their entry into the field and any training they may need. Over the many years of service the Law Society has been around offering support to those solicitors who may need additional services. They have been there to help with client issues and they have also provided events and they offer guidance to young solicitors as to how to run their businesses the right way. In addition they also have two special programs that are of interest to many other solicitors such as the “Lawyers with Disabilities Division” and they also have the “Competition Section.” In addition they give many different conferences and workshops that allow their members to get further information. Another great thing is that they actually support the business of International law through one of its divisions. Monday, January 18. 2010UK Solicitors: Continuing Professional DevelopmentThe UK has requirements that their solicitors who are practicing must have continuing education so that they can be up to date on the latest changes in the law. This regulation is called the CPD (continuing professional development) Scheme and it means that they are required to take at least ten hours of development courses in the first two cycles in order for them to continue in practice.These requirements involve taking “Management and Professional Development Skills” classes as well as group study classes. The solicitors must take these classes in cycles, in the first two cycles they are required ten hours but in the next cycle the amount will increase to group study at 15 hours and “Management and Professional Skills” for another four hours.The UK, in the past allowed a solicitor to take their hours in private study, however since the new regulations this is no longer an option. They however do allow a solicitor to acquire these hours through e-learning venues for up to two hours of CPD per cycle. There is an exception to this rule, and that is where the solicitor writes articles for use in law periodicals and in law school textbooks, which will account for up to two hours of the CPD education requirement.A solicitor must take some of this requirement in a group study session in which three or more solicitors are learning together for thirty or more minutes. The class must be verifiable and it must be either in the form of a seminar, video conference, lecture, workshop, and tutorial or certificate program. It may also be run by one of the different firms, the bar association or a law society. Credit is given only for the actual hours of contact which means breaks and registration does not count toward the hours.There is also a requirement for proof of attendance that must be provided as evidence that must be submitted to meet the compliance of the training regulation. When a solicitor takes part in one of these group studies as a delegate (instructor), he or she will receive an additional one-quarter of the hours needed to meet their CPD requirement. In addition if that solicitor leads the lecture or the tutorial they will get up to 4 hours of time toward this requirement.Since one of the biggest problems most solicitors have, they are required to take at the very least three hours in the “management and professional skills” class every cycle.
